Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CREATRS mobile application, website, and related services (together, the "Platform"). By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. Who we are

CREATRS operates a marketplace that connects user-generated content ("UGC") creators with brands running marketing campaigns, and facilitates protected (escrow) payouts for completed work.

2. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract.
Creators register with a phone number and verify it via a one-time code (OTP) sent over WhatsApp. Brands register with a work email and verify it via an emailed OTP.
You are responsible for keeping your login credentials secure and for all activity under your account.
You agree to provide accurate information and to keep it up to date. Brands may be asked to complete identity/business verification (KYC) before funding campaigns.

3. Campaigns, briefs & submissions

Brands publish campaign briefs describing deliverables and terms.
Creators may apply to or be invited to briefs. Approval is at the brand's discretion, subject to Platform rules.
Creators are responsible for producing original content that complies with the brief, applicable law, and the disclosure rules of the relevant social platforms (e.g. clearly marking paid partnerships).

4. Payments & escrow

Brands fund campaigns in advance. Funds are held in a protected balance and released to creators when deliverables are approved, per the brief.
CREATRS may charge platform and processing fees, which will be disclosed before a transaction completes.
Payouts, refunds, and cancellations are handled according to the campaign terms and our then-current payout policy.

5. Acceptable use

You agree not to:

Post false metrics, use bots, or otherwise manipulate engagement.
Infringe anyone's intellectual property or privacy rights.
Submit unlawful, misleading, hateful, or harmful content.
Circumvent the Platform to avoid fees or escrow protections.
Attempt to access, disrupt, or reverse-engineer the Platform.

6. Content & licenses

You retain ownership of content you create. By submitting content, you grant the relevant brand the license described in the applicable brief, and you grant CREATRS a limited license to host, display, and process the content as needed to operate the Platform.

7. Suspension & termination

We may suspend or terminate accounts that violate these Terms, engage in fraud, or create risk for other users. You may stop using the Platform at any time.

8. Disclaimers & limitation of liability

The Platform is provided "as is" without warranties of any kind. To the maximum extent permitted by law, CREATRS is not liable for indirect, incidental, or consequential damages arising from your use of the Platform.

9. Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date, and material changes may be communicated in-app or by email.
